Q: What does the fiance and/or marriage visa application process for a Cambodian national involve?

A: K1 fiancee visas for Cambodia nationals involve filing an initial petition with the United States Citizen and Immigration Services (USCIS). After the USCIS forwards the petition to the American Embassy in Bangkok, the petitioner and applicant will be responsible for submitting additional forms and documents to the American Embassy in Bangkok. For the final phase of the application process, the applicant will be interviewed by a representative from the American Embassy in Bangkok.

Cambodian nationals should be aware that the US Embassy does not send mail to Cambodia. Therefore all correspondance from the Embassy as well as information about the final interview appointment will be sent to the petitioner in America (or their representative) who will be responsible for forwarding the information to the Cambodian visa applicant.

 
Q:When applying for an immigrant visa does a Cambodian national have to appear in person at the American Embassy in Bangkok?
A: With the exception of Cambodian K3 marriage visa applicants, Cambodian nationals applying for an immigrant visa will be required to report to the American Embassy in Bangkok for their final interview. US immigration law requires that the spouse of a US citizen be interviewed in the country where they were wed to the petitioner. Therefore if the K3 marriage visa applicant was married in Cambodia, he or she will be interviewed in Phnom Penh by a representative from the American Embassy in Bangkok.
 
Q: How long does the fiance and/or marriage visa application process typically take for a Cambodian national?
A: Generally, the process takes between 4 to 8 months depending on the length of time it takes for the USCIS and the Consular office to process the case. Marriage visas typically take a little longer than fiance visas, due to the additional step of filing for an immigrant visa number. Cambodian nationals without a legal representative in Bangkok should also factor in mailing time. As the US Embassy in Bangkok does not send mail to Cambodia, all correspondence from the Embassy will be mailed to the petitioner in the US who must forward it to the Cambodian applicant. Correspondence from the US Embassy in Bangkok typically takes about one month to reach the US.
 
Q: Can I submit visa application documents or solicit immigration advice from the American Embassy in Cambodia?
A: The American Embassy in Cambodia will not accept any documents or answer any questions pertaining to immigration. The American Embassy in Bangkok handles the process in its entirety.
 
Q: Does the US Embassy in Bangkok accept medical examinations from hospitals in Cambodia?

A: The US Embassy has authorized physicians at two hospitals in Cambodia to conduct medical examinations for visa applicants. These hospitals are the International Organization for Migration (IOM) and the International SOS Pte, Ltd., both in Phnom Penh. Cambodian visa applicants can also choose to undergo their medical examination at the Bangkok Nursing Home or the Bumrungrad Hospital in Bangkok.

For Cambodian marriage visa applicants who are residing close to Phnom Penh, undergoing a medical examination in Phnom Penh, the town of their interview, makes the best sense. Applicants for other types of visas will need to decide where it is most advantageous to undergo their medical examination. While Phnom Penh may be closer, problems identified in the medical report at the time of the interview can be more easily and quickly resolved at a hospital in Bangkok.

 
Q: Are Cambodian nationals eligible to enter the US Diversity Lottery?

A: The Diversity Lottery makes available 50,000 permanent resident visas annually to persons from countries with low rates of immigration to the United States. For the 2005 Diversity Lottery, Cambodia was one of the countries whose nationals were able to participate in the lottery.
