US Immigration Lawyer Specializing Thailand

Where can Thai nationals apply for a US visa?

Thai nationals may file US visa applications at the US Consulate in Bangkok as well as at the US consulate in Chiang Mai.  Visa applications or inquiries may be made during the hours of operation the Consular Section has established for visas in that category.  (See the Schedule of Operation for the Bangkok Consulate and the Chiang Mai Consulate.)

Family Based Immigration claims, such as the
K-1 fiancee visa, K-3 spouse visa and Immediate Relative Visa require the US citizen sponsor to submit a petition to the USCIS office with jurisdiction over the US citizen's area of residence prior to the Thai applicant filing an application in Thailand.  Certain types of non-immigrant visas, such as employment visas, also require a prior petition to be filed with a US government office in the US.

In what circumstances may a US citizen file a petition to sponsor a fiancee, spouse or relative at the USCIS office in Bangkok?

US citizens residing in Thailand (and certain other Southeast Asian countries) may, under certain circumstances, file their petition to sponsor the immigration of a fiancee, spouse or relative at the USCIS in Bangkok.  Evidence of permanent resident status, a long term visa and/or a work permit is typically required.

In what circumstances do US citizens need to file a petition with the USCIS office in Bangkok?

The United States Citizen and Immigration Services (USCIS) Office in Bangkok receives immigrant visa petitions from US citizens residing in its area of jurisdiction. The USCIS is not a consular office and does not process visa applications.  US citizen petitioners residing in the US will need to file their petitions with the USCIS office with jurisdiction over their state.

The USCIS in Bangkok receives I-130 Petitions to Sponsor an Immediate Relative from US citizens residing in Thailand, Australia, Burma, Cambodia, Laos, Singapore, Indonesia, Malaysia, Brunei, East Timor and New Zealand.

Can US petitioners accompany their Thai fiancee, spouse or relative to the visa interview?

Normally the US embassy official policy is to request to interview the applicant alone. There are certain exceptions made for children and other special circumstances.
